Driving Under the Influence of Alcohol

The client is charged with DUI causing a rollover accident on the freeway. The D.A. wants jail time, as the client has prior convictions. The prosecution theory is that although he is the passenger he is the "driver" for DUI purposes as he allegedly reaches over and assumes control of the vehicle by jerking the wheel to the right, causing the wreck. California case law specifically supports that position. The sole witness to this behavior is the driver. The defense position is that she, not the client, turned the wheel while in a drug induced rage. After a prolonged discovery battle related to her pending legal problems, the D.A.'s confidence in their case is compromised, and the matter settles for a drunk in public misdemeanor with no jail time and a token fine. Grand Theft
